1. Services
Drone Flying Company provides real estate photography, videography, drone aerial imaging, virtual staging, 3D virtual tours, and related media services. Specific deliverables and pricing are confirmed in writing for each booking.
2. Booking & payment
Confirmation. Bookings are confirmed once a date and package are agreed in writing (email is sufficient).
Payment. Payment is due within 7 days of delivery unless otherwise agreed. We accept e-transfer, credit card, and corporate cheques. Late payments past 30 days incur 2% monthly interest.
Cancellation. Bookings cancelled with more than 24 hours notice are fully refundable. Cancellations within 24 hours of the scheduled shoot are subject to a 50% fee. Same-day cancellations are billed in full.
3. Weather & rescheduling
Aerial drone work depends on weather and Transport Canada flight conditions. If weather prevents safe operation, we will reschedule at no charge. Photo and video shoots indoors proceed regardless of weather.
4. Property access & safety
The client is responsible for ensuring legal access to the property, that the property is photo-ready (see our prep checklist), and that pets and children are secured during the shoot. We cannot photograph occupied bedrooms with people present and reserve the right to skip rooms that are not adequately prepared.
5. Drone operations
All drone work is performed under Transport Canada Advanced Operations certification with $2 million liability insurance. We comply with the Canadian Aviation Regulations Part IX. Some sites may be flight-restricted; we will advise if alternative ground-based aerial methods are needed.
6. Copyright & licensing
Ownership. All photographs, videos, and digital files remain the copyright of Drone Flying Company.
Client license. Upon full payment, the client receives a non-exclusive, non-transferable licence to use the delivered media for marketing the specific listing the work was commissioned for. This includes use on MLS, the listing brokerage’s website, the client’s personal real estate marketing, and standard social media platforms.
Restrictions. The licence does not permit resale, sublicense to third parties (e.g. publications, stock libraries), modification beyond simple cropping for platform requirements, or removal of any visible watermark/credit if applicable. Photo editing services from third parties (e.g. virtual staging by another vendor) require our prior written consent.
Portfolio rights. We retain the right to use any work we produce in our portfolio, on our website, in social media, and for marketing — including before-and-after showcases.
7. Revisions & deliverables
The number of revision rounds is specified in your package. Additional revisions are billed at our standard rate. Standard delivery time is stated per package; rush delivery is available for an additional fee. Files are delivered via private download link and archived on our cloud storage for 5 years.
8. Liability
Our liability is limited to the amount paid for the specific service. We are not liable for indirect or consequential damages including but not limited to lost listings, delayed sales, or third-party platform issues. Drone-related property damage is covered by our liability insurance up to the policy limit.
9. Disputes
Any disputes arising under these terms shall be resolved under the laws of the Province of Alberta, Canada. The parties agree to attempt good-faith negotiation before pursuing legal action.
10. Changes to terms
We may update these terms from time to time. The version in effect on the date of your booking applies for that engagement.
